Know Your Rights

REMAIN SILENT

Give your name if asked, but you have the right to remain silent about everything else. Anything you say can be used against you. If you want to exercise your right to remain silent, you should say so.

You have the right to speak to an attorney before answering any questions. You may say, “I will remain silent until I speak to an attorney.”

If you are here because a loved one is already in jail, they shouldn’t discuss the details of their case with ANYONE other than their lawyer, including you. Never agree to a police interview, especially without a lawyer present.

DENY Entry/search

You do NOT have to open the door to ANYONE unless they have a warrant signed by a judge. ICE agents and police officers can't search you, your home, or your car without a warrant signed by a judge.

Don’t sign

Do not sign forms you don't understand or don’t want to sign. You have the right to speak with an attorney.

For more information about your rights when interacting with law enforcement, see Uprise Theatre’s Know Your Rights posters. Uprise Theatre is a FREE SD partner organization that uses art and activist lawyering to disrupt systems of oppression and reclaim power with the people.
